DMCA / Copyright Policy
How to file a copyright takedown notice, counter-notification process, and repeat infringer policy.
1. Overview
QuantumCampus LLC ("Company") complies with the Digital Millennium Copyright Act (17 U.S.C. § 512, "DMCA"). This policy describes:
- Copyright compliance procedures
- How to file a DMCA takedown notice
- The counter-notification process
- Penalties for false claims
- The Company's repeat infringer policy
2. Designated DMCA Agent
Pursuant to 17 U.S.C. § 512(c)(2), the Company designates the following agent to receive DMCA notices:

DMCA Agent Registration: The Company maintains a current DMCA agent designation with the U.S. Copyright Office online directory at https://www.copyright.gov/dmca-directory/. The Company is responsible for ensuring this registration remains current and renewing it as required by the Copyright Office (currently every three years). If the DMCA Agent's contact information changes, the Company will update the registration within 30 days.
Note to Company Legal Team: DMCA safe harbor protection under 17 U.S.C. § 512(c) requires an active, current agent designation filed with the Copyright Office. Verify registration status at https://www.copyright.gov/dmca-directory/ and renew before expiration. Failure to maintain a current designation may result in loss of safe harbor protection.
3. Copyright Compliance
3.1 Company Commitment
QuantumCampus LLC respects intellectual property rights and does not knowingly host, publish, or enable infringement of copyrighted material. The Company:
- Maintains policies to prevent copyright infringement
- Promptly investigates and responds to infringement reports
- Removes infringing content when appropriate
- Terminates repeat infringers' accounts
3.2 User Responsibility
Users of the DentistJourney Platform agree to:
- Not upload, publish, or transmit copyrighted material without authorization
- Respect all copyright, trademark, and intellectual property rights
- Not engage in activity that violates intellectual property law
- Comply with all applicable copyright laws and regulations
3.3 Content Claims
Users claiming copyright in any work represent and warrant that:
- They own or control all rights to the work
- The work is original or properly licensed
- They have the right to grant rights to the Company
- They are not infringing any third-party rights
4. DMCA Takedown Notice Procedures
4.1 Filing a DMCA Notice
If you believe copyrighted material is infringed on the DentistJourney Platform, you may file a DMCA takedown notice. The notice must include:
4.2 Required Elements of Notice (17 U.S.C. § 512(c)(3))
A valid DMCA takedown notice must contain:
Identification of Work: A description of the copyrighted work claimed to be infringed
Location of Infringement: Identification of the material on the Platform that is claimed to be infringing, with sufficient detail for the Company to locate the material, including:
- The URL or page where the infringing material appears
- A description of the specific content
- Dates or times the material was accessed
- Any identifying numbers or characteristics
Claimant Information: The name, address, telephone number, and email address of the person claiming infringement
Representation of Authority: A statement that the claimant has good faith belief that use of the material is not authorized and infringes copyright
Accuracy Statement: A statement that the information in the notice is accurate, and under penalty of perjury, that the claimant is authorized to act on behalf of the copyright owner
Signature: The physical or electronic signature of the copyright owner or authorized representative
Contact Information: A telephone number and email address where the Company may contact the claimant
4.3 Submission Method
DMCA notices must be submitted to the Designated DMCA Agent:

4.4 Notice Requirements
For the notice to be effective, it must:
- Comply with all statutory requirements in 17 U.S.C. § 512(c)(3)
- Be signed physically or electronically
- Be submitted to the DMCA Agent
- Contain complete and accurate information
- Be in English (or translated English summary provided)
4.5 Incomplete Notices
The Company shall not be required to act on incomplete notices. Notices lacking required elements may be rejected or requests for clarification made.
5. Company Response to DMCA Notices
5.1 Investigation
Upon receipt of a valid DMCA notice, the Company shall:
- Investigate the claim of infringement
- Determine whether the content appears to infringe the claimed copyright
- Verify the notice contains all required elements
- Assess whether a valid copyright claim exists
5.2 Removal
If investigation indicates likely infringement, the Company shall:
- Remove the allegedly infringing material promptly
- Disable access to the material
- Terminate the user's access to the material if necessary
5.3 Notice to User
The Company shall notify the affected user of:
- The removal of content
- The reason for removal
- The identity and contact information of the claimant (if appropriate)
- The user's right to file a counter-notification
- Procedures for counter-notification
5.4 Timing
The Company shall respond to valid DMCA notices without unreasonable delay, typically within 5-10 business days of receipt.
5.5 No Guarantee
The Company makes no guarantee that it will receive, process, or act on any particular DMCA notice.
6. Counter-Notification Process (17 U.S.C. § 512(g))
6.1 Right to Counter-Notify
If material has been removed due to a DMCA notice, the user may file a counter-notification asserting:
- The material was removed in error
- The user has the right to use the material
- The claimant is misrepresenting the infringement
6.2 Requirements for Counter-Notification
A valid counter-notification must include:
Identification: The user's name, address, telephone number, and email address
Identification of Material: Identification of the specific material that was removed and the location where the material appeared before removal
Statement of Accuracy: A statement under penalty of perjury that:
- The user has a good faith belief that the material was removed in error
- The user has the legal right to use the material
- The user is not infringing the copyright owner's rights
Consent to Jurisdiction: A statement that the user consents to jurisdiction in the Federal District Court for the judicial district where the user's address is located (or in Sacramento County, California if the address is outside the United States)
Authorization: A statement that the user will accept service of legal proceedings from the copyright claimant
Signature: Physical or electronic signature of the user
6.3 Submission of Counter-Notification
Counter-notifications must be submitted to:

6.4 Company Response to Counter-Notification
Upon receipt of a valid counter-notification, the Company shall:
- Notify the original claimant of the counter-notification
- Provide the claimant information from the counter-notification
- Advise the claimant of the user's challenge
- Wait 10-14 business days for the claimant to file legal action
- Restore the material if no legal action is filed within the waiting period
- Restore material if directed by the claimant in writing
6.5 Timing for Restoration
Material shall be restored without unreasonable delay after the waiting period unless the Company receives notice that legal action has been filed.
7. Repeat Infringer Policy
7.1 Termination for Repeat Infringement
QuantumCampus LLC shall terminate the accounts of users who are repeat infringers of copyright. Repeat infringers are users who:
- Have received multiple valid DMCA notices regarding copyright infringement
- Have been subject to multiple takedown notices
- Have demonstrated a pattern of copyright infringement
7.2 Determination of Repeat Infringement
The Company uses its discretion in determining whether a user is a "repeat infringer" based on:
- Frequency and severity of infringement
- Time period between infringement incidents
- Responsiveness to DMCA notices
- User intent and willfulness
- Overall pattern of conduct
7.3 Termination Procedure
Prior to termination, the Company shall:
- Provide written notice of the repeat infringement determination
- Allow the user reasonable opportunity to respond or cure
- Document the basis for repeat infringer determination
Users terminated as repeat infringers shall have no further access to the Platform, and any remaining content shall be removed.
7.4 Account Suspension
The Company may suspend user accounts during investigation of alleged copyright infringement.
8. Good Faith Requirement
8.1 Good Faith Standards
Both DMCA notices and counter-notifications must be filed in good faith. Users filing notices represent that:
- The information provided is accurate
- They have investigated the claim thoroughly
- They have legal basis for the claim
- They are not misrepresenting facts
8.2 Abuse Prevention
The Company shall take reasonable steps to prevent abusive filing of:
- Frivolous DMCA notices
- False counter-notifications
- Notices filed in bad faith
8.3 Investigation
The Company may investigate claims that either party filed notice in bad faith and may:
- Request additional information
- Require verification of claims
- Refer matters to law enforcement if warranted
9. False Claims Warning and Perjury Liability
9.1 Statutory Liability
The DMCA imposes significant penalties for false claims. Pursuant to 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing or was disabled in error is liable for:
- Damages (including lost profits)
- Attorney's fees and costs
- Such other relief as equity may provide
This liability applies to copyright claimants AND users filing counter-notifications.
9.2 Perjury Warning
DMCA notices and counter-notifications are submitted under penalty of perjury. Making a false statement may result in:
- Criminal penalties (up to 5 years imprisonment, fines up to $250,000)
- Civil liability (damages, attorney's fees)
- False claims sanctions
9.3 False Claims by Copyright Claimants
Copyright claimants filing false or abusive DMCA notices may face:
- Liability under 17 U.S.C. § 512(f)
- State unfair competition laws
- Defamation claims
- Malicious prosecution claims
- Injunctive relief against further notices
9.4 False Claims by Users
Users filing false counter-notifications or abusive notices may:
- Face civil liability
- Have accounts terminated
- Be reported to law enforcement
- Lose the right to file future notices
9.5 Company Discretion
The Company reserves discretion to investigate any DMCA notice or counter-notification it believes may be filed in bad faith and to take appropriate action.
10. Copyright and Intellectual Property
10.1 Company IP
All content on the DentistJourney Platform, including text, images, code, designs, and functionality, is the intellectual property of QuantumCampus LLC or licensed to the Company. Users may not:
- Copy, modify, or create derivative works
- Republish or redistribute content
- Use content for commercial purposes
- Reverse engineer or extract content
10.2 Fair Use
Criticism, commentary, news reporting, teaching, scholarship, and research may constitute "fair use" of copyrighted material. The Company respects fair use rights but makes no determination of fair use applicability.

11. Non-Affiliate Notification
This Policy applies to the DentistJourney Platform at dentistjourney.com. The Company does not control third-party websites or services and is not responsible for their copyright compliance.
12. Governing Law and Jurisdiction
This Policy shall be governed by and construed in accordance with the laws of the State of California. All disputes arising under this Policy shall be resolved in Sacramento County, California, and the Parties consent to jurisdiction in federal and state courts located there.
13. Severability
If any provision is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.
14. Entire Agreement
This Policy constitutes the entire agreement regarding copyright and DMCA procedures and supersedes all prior understandings.
15. Amendment
The Company reserves the right to amend this Policy at any time. Amendments shall be effective upon posting to the Platform.
